Pennsylvania DUI Laws And Penalties For CDL Holders

Per Pennsylvania Driving Under the Influence law it does not matter if you were driving your commercial vehicle or your own personal vehicle at the time of arrest. The laws remain the same although the consequences regarding your professional drivers license are very severe.

The legal limit for Blood Alcohol Content (BAC) while operating your commercial vehicle is .04. This is compared to the legal limit of .08 if operating your personal vehicle. If convicted of a DUI in Pennsylvania, even if you were not driving your work vehicle, you are subject to a 1 year CDL disqualification. This is in addition to your personal drivers license suspension, penalties, fines, etc. If you were in your commercial vehicle at time of arrest there is an additional one year CDL suspension. If you were transporting hazardous materials when arrested your suspension will increase to 3 years. If you are convicted of a subsequent DUI, whether one or both DUI’s occurred in your personal vehicle, you will be banned for life from possessing a CDL in Pennsylvania. Again, this is in addition to any penalties, fines, fees or jail sentences you may face regarding your personal drivers license.
