BREAKING NEWS: Federal Court Orders DHS to Notify Eligible Detainees of Bond Rights
A federal judge has ordered the Department of Homeland Security (DHS) to notify certain non-citizens in immigration detention if they are eligible for release on bond under federal law.
Under a recent federal court ruling in Lazaro Maldonado Bautista et al. v. Ernesto Santacruz Jr. et al., the United States District Court for the Central District of California determined that some immigration detainees may qualify for bond or conditional parole under 8 U.S.C. § 1226(a).
As part of the Court’s order:
- DHS must notify detained non-citizens if they are eligible for a bond.
- Eligible individuals may request release on bond or conditional parole.
- Detention facilities must provide access to a telephone within one hour of delivering the notice so the individual can contact an attorney.
